Use your word processor “Table” feature to prepare a table or chart with two columns and sixteen rows. Label the first column ‘Rule’ and the second column ‘Description’. Label the chart/table as “Federal Rules of Civil Procedure (“FRCP”) Addressing the Discovery of ESI” Now using a search engine, locate the Federal Rule of Civil Procedure (“FRCP”). In particular, include Rule 1, 4(m), 16(b), 16(b)(1), 16(b)(2), 26(b)(1), 26(b)(2), 26(b)(5), 26(d)(2), 26(f), 26(f)(3), 34(a)(1), 34(b), 37(e) and 37(f) as your row headings/headers.

At the bottom of the chart – answer the following question:

  1. When were the Federal Rules of Civil Procedure (FRCP) adopted?
  2. When were the Federal Rules of Civil Procedure (FRCP) amended codifying the inclusion of ESI?
  3. When were the Federal Rules of Civil Procedure (FRCP) overhauled to reflect the most significant changes to the timing and procedure surrounding case management, the scope of discovery and the spoliation of ESI while emphasizing the need for proportionality and cooperation between parties?

Save your files as a Word document (.doc or .docx) using the following naming convention to name your document: ‘First Name, Last Name – C6L2.doc.’

TIP: When identifying information for column 2 you are notating the most current/amended rule referenced in column 1. There is no need to copy the entire rule in the ’Rule’ and/or ’Description’ columns, a brief summary of the rule is sufficient in the ‘Description’ column. Please see the following example:
